1.1 What ARious Provides

ARious is an educational platform that teaches human anatomy through interactive augmented reality (AR) lessons and artificial intelligence (AI) powered voice tutoring. The Service includes:

Augmented Reality Lessons: Interactive 3D anatomical models that students can explore using their mobile device's camera, allowing them to visualize and learn about human body systems in an immersive environment.

AI Voice Tutoring (ARious): An artificial intelligence tutor named "ARious" that engages students in voice conversations about human anatomy. Students can ask questions using their voice, and ARious responds with educational explanations.

Physical Learning Kits: 3D printed anatomical models shipped to subscribers as companions to the digital lessons (availability varies by subscription plan).

1.2 Educational Purpose

ARious is designed for educational purposes only. The anatomical information provided through our lessons and AI tutor is intended for general learning and should not be used for medical diagnosis, treatment decisions, or as a substitute for professional medical advice. If you have health concerns, please consult a qualified healthcare provider.

1.3 Service Availability

We strive to maintain continuous availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

2. Eligibility and Account Registration

2.1 Who Can Use ARious

ARious is designed for students ages 13 and older. Children under 13 may use ARious only with verified parental consent as described in Section 3 below.

Parents and Guardians: If you are registering an account for your child's use, you represent that you are the parent or legal guardian of the child and have the authority to agree to these Terms on their behalf.

Geographic Availability: The Service is currently available to users in the United States. We may expand availability to other regions in the future.

2.2 Account Registration

To access certain features of the Service, including AI-powered lessons, you must create an account on our website (arious.ai). When registering, you agree to:

• Provide accurate, current, and complete information

• Maintain and update your information to keep it accurate

• Maintain the security of your account credentials

• Accept responsibility for all activities that occur under your account

• Notify us immediately of any unauthorized access or security breach

2.3 One Account Per Subscription

Each subscription is associated with one account and is intended for use by one household. Account credentials may not be shared with individuals outside your household. We reserve the right to terminate accounts that we reasonably believe are being shared inappropriately.

3. Children's Use and Parental Consent

3.1 Parental Responsibility

ARious takes children's privacy and safety seriously. If you are a parent or guardian registering for your child to use ARious:

• You are responsible for supervising your child's use of the Service

• You consent to your child's interaction with our AI tutor and the collection of data as described in our Privacy Policy

• You agree to these Terms on behalf of your child

• You confirm that you have provided any required parental consent before your child accesses voice-enabled features

3.2 Children Under 13

For children under 13, we require verifiable parental consent before the child can access AI-powered voice features, in compliance with the Children's Online Privacy Protection Act (COPPA). By completing the registration and payment process for a child under 13, you are providing this consent.

3.3 Content Appropriateness

Our content is designed to be educational and age-appropriate. However, anatomical education necessarily involves discussion of body parts and biological functions. If you have concerns about specific content, please contact us at support@arious.ai before subscribing.

4. Subscriptions and Payment

4.1 Subscription Plans

ARious is offered on a subscription basis. Current subscription plans, pricing, and included features are displayed on our website at the time of purchase. We reserve the right to modify subscription plans and pricing, but changes will not affect your current billing cycle.

4.2 Free Trial

We may offer free trials of certain features. At the end of a free trial, you will be automatically charged for the subscription plan you selected unless you cancel before the trial ends. We will notify you before charging.

4.3 Payment Processing

Payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you authorize us to charge the applicable subscription fees to your designated payment method. You agree that:

• Your payment information is accurate and you are authorized to use the payment method

• You will promptly update your payment information if it changes

• Stripe's terms of service apply to payment processing

4.4 Billing Cycle

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your billing cycle begins on the date you complete your initial purchase.

4.5 Price Changes

We may change subscription prices from time to time. If we increase prices, we will provide at least 30 days' notice before the change takes effect. You may cancel your subscription before the price change becomes effective if you do not wish to pay the new price.

4.6 Taxes

Subscription fees do not include applicable taxes. You are responsible for paying any taxes associated with your subscription based on your location.

5. Invite Codes and Access

5.1 Invite Codes

Access to certain features, including AI-powered lessons, may require an invite code. Invite codes are issued to registered subscribers after payment is confirmed.

5.2 Invite Code Restrictions

Invite codes are:

• Non-transferable: Codes are issued to specific subscribers and may not be sold, traded, or given to others outside your household

• Single-use: Each code can only be used to activate one device or child profile

• Subscription-linked: Codes are valid only while your subscription remains active

5.3 Code Misuse

We reserve the right to invalidate invite codes and terminate accounts if we determine that codes are being shared, sold, or used in violation of these Terms.

6. Cancellation and Refunds

6.1 How to Cancel

You may cancel your subscription at any time by:

• Visiting your account settings on arious.ai

• Contacting us at support@arious.ai

Cancellation will take effect at the end of your current billing cycle. You will continue to have access to the Service until that date.

6.2 Refund Policy

Within First 14 Days: If you are not satisfied with ARious, you may request a full refund within 14 days of your initial purchase, provided that any physical items shipped to you are returned in unused condition.

After 14 Days: Subscription fees are generally non-refundable after the initial 14-day period. However, we may consider refund requests on a case-by-case basis for extenuating circumstances.

Partial Month: We do not provide prorated refunds for partial months if you cancel mid-cycle.

6.3 Effect of Cancellation

Upon cancellation:

• Your access to paid features will end at the conclusion of your current billing cycle

• Your child's conversation history and learning progress may be deleted after 30 days

• Unused invite codes will be invalidated

7. Acceptable Use

7.1 Permitted Use

You may use ARious for personal, non-commercial educational purposes in accordance with these Terms. This includes:

• Accessing lessons and interacting with our AI tutor

• Using AR features to visualize anatomical models

• Reviewing your child's learning progress

7.2 Prohibited Conduct

You agree not to:

Misuse the AI Tutor:

• Attempt to manipulate, confuse, or "jailbreak" the AI through adversarial prompts

• Use the AI tutor for purposes other than anatomy education

• Attempt to extract the AI's underlying instructions, training data, or system prompts

• Generate or solicit inappropriate, harmful, or non-educational content

Violate Security:

• Attempt to gain unauthorized access to any part of the Service

• Interfere with or disrupt the Service or servers

• Circumvent security measures or access controls

• Reverse engineer, decompile, or disassemble any part of the Service

Infringe Rights:

• Copy, reproduce, distribute, or create derivative works of our content

• Use our trademarks, logos, or branding without permission

• Record, screenshot, or capture lesson content for redistribution

Harm Others:

• Harass, threaten, or harm other users or ARious personnel

• Impersonate any person or entity

• Share another person's personal information without consent

7.3 Enforcement

We reserve the right to investigate violations of these Terms and take appropriate action, including:

• Warning or suspending your account

• Terminating your account without refund

• Reporting illegal activity to law enforcement

• Pursuing legal remedies

8. Intellectual Property

8.1 ARious Content

All content provided through the Service, including but not limited to 3D models, lesson materials, animations, illustrations, text, audio, the ARious character, and software, is owned by ARious or our licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial educational purposes. This license does not include the right to:

• Modify, copy, or distribute our content

• Use our content for commercial purposes

• Remove any copyright or proprietary notices

• Transfer your license to another person

8.3 Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate that Feedback into the Service without compensation or attribution to you.

8.4 Trademarks

"ARious," "ARious," and our logos are trademarks of CodexAR INC. You may not use our trademarks without prior written permission.

9. AI Tutor Disclaimer

9.1 Nature of AI

ARious is an artificial intelligence system that generates responses based on machine learning models. While we strive for accuracy, you acknowledge that:

• AI responses are generated algorithmically and may occasionally contain errors

• ARious is not a human tutor and cannot exercise human judgment

• AI technology has inherent limitations in understanding context and nuance

• Responses may vary even for similar questions

9.2 Not Medical Advice

Information provided by ARious is for educational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations. The anatomical information is intended for general learning about the human body, not for making health-related decisions.

9.3 Accuracy Limitations

While our AI is trained on educational content about human anatomy, we do not guarantee that all information provided is complete, current, or error-free. For academic or professional purposes, please verify information through additional authoritative sources.

9.4 Content Monitoring

We implement safety measures to keep AI interactions appropriate and educational. However, we cannot guarantee that all AI responses will be perfectly suitable for all users at all times. If you encounter problematic content, please report it to support@arious.ai.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, available at arious.ai/privacy. Our Privacy Policy explains how we collect, use, and protect your information, including special provisions for children's data under COPPA. By using the Service, you consent to the practices described in our Privacy Policy.

11. Third-Party Services

11.1 Third-Party Integrations

The Service may integrate with or link to third-party services, including:

• Stripe for payment processing

• Apple App Store and Google Play Store for app distribution

ARious is an educational supplement and is not intended to replace formal education, professional instruction, or expert guidance. We make no representations about the educational outcomes you or your child will achieve.

13. Limitation of Liability

13.1 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARIOUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL

• ANY DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE

• ANY DAMAGES RESULTING FROM CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE

• ANY DAMAGES RESULTING FROM RELIANCE ON CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE

13.2 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13.3 Exceptions

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

14. Indemnification

You agree to indemnify, defend, and hold harmless ARious and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service

• Your violation of these Terms

• Your violation of any third-party rights

• Any content you submit or transmit through the Service

• Your child's use of the Service under your account

15. Dispute Resolution

15.1 Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of California, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing any formal legal action, you agree to first contact us at legal@arious.ai to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days of receiving your notice.

15.3 Arbitration Agreement

If we cannot resolve a dispute informally, you and ARious agree to resolve any claims relating to these Terms or the Service through final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will take place in Los Angeles County, California, unless we agree otherwise.

15.4 Class Action Waiver

YOU AND ARIOUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.5 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15.6 Small Claims

Either party may bring qualifying claims in small claims court.

16. Termination

16.1 Termination by You

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

16.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, including if we reasonably believe that:

• You have violated these Terms

• Your account has been used for unauthorized purposes

• Continuing to provide the Service to you would be impractical or problematic

16.3 Effect of Termination

Upon termination:

• Your right to access the Service will immediately cease

• We may delete your account data, including your child's learning progress and conversation history

• Any provisions of these Terms that by their nature should survive termination will survive (including Sections 8, 12, 13, 14, 15, and 17)

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ARious regarding the Service and supersede any prior agreements.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

17.5 Notices

We may provide notices to you through the Service, by email to the address associated with your account, or by other reasonable means. You may provide notices to us at legal@arious.ai or by mail to our address listed above.

17.6 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, labour disputes, government actions, or internet service failures.

18. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

If you are a parent or guardian registering on behalf of your child, you acknowledge that you have the authority to bind your child to these Terms and accept full responsibility for your child's use of the Service.
